SIOUX CITY (KTIV) - The lawyer for a Hubbard man who's charged in Iowa with killing his wife, wants statements made in a police interview excluded from his upcoming trial.
Twenty-eight-year-old Rogelio Morales will go to trial for first-degree murder on September 20th. Morales is accused of killing 21-year-old Margarita Morales of South Sioux City on April 19th.
After his arrest, Morales was interviewed by police. Morales' attorney says after his client was read his Miranda rights, he “barely nodded his head.” Attorney Peter Tenny claims his client made no verbal statement, and was completely silent. Tenny says that is insufficient to satisfy the burden of a valid, voluntary Miranda waiver.
